The Punjab and Haryana High Court on Wednesday issued a notice directed the contractor who was allotted contractor of mineral quarry in Gag Dhagara village to file an affidavit in the court within two weeks.
A division bench comprising Justice Sureshwar Thakur and Justice Kuldeep Singh passed this order on an Execution Appeal filed by Gag Dhagara village panchayat.
The court order said that co-respondent no 6 will within two weeks file an affidavit on the requisite steps being taken.
Village sarpanch Banat Kaur has filed an execution appeal in the court submitting that the former sarpanches had filed a civil writ petition in the Punjab and Haryana High Court in 2015 seeking directions to a private contractor to deposit the balance amount of the contract money with the panchayat.
Contractor Brindar Singh Dhillon a resident of 1442 Sector 34-C Chandigarh was allotted contractor of a mineral quarry in Gag Dhagara in 2013 by the mining department, which continued operations until 2015.
The Mining Department had deducted an amount of Rs 1,48,15,757 from the security deposit of the contractor after an order by the Punjab and Haryana High Court.
Justice Surya Kant and Justice PB Bajanthri, disposing of the petition filed by Gag Dhagra panchayat, had said in their judgment on February 2, 2016, that the needful, including the determination of the amount payable by the private contractor, should be done within three months. It had directed the Mining Department to deduct the amount from the security deposit and release the gram panchayat’s share within a month.
