Illegal colony in Kotkapura:BJP district president Gaurav Kakkar booked with another for criminal breach of trust,cheating and criminal conspiracy

BJP district president Gaurav Kakkar, a resident of Faridkot and another person Mukesh Garg, a resident of Kotkapura have been allegedly booked at city police station Kotkapura under section 420,120B and 406 of IPC.

The duo have been booked on the complaint of Surjeet Singh,77, son of Santa Singh, a resident of Surgapuri locality Kotkapura.

The accused had moved an application with the SSP Faridkot on August 21,2023 alleging that Gaurav Kakkar and Mukesh Garg had allegedly planned a colony in Kotkapura and they sold the plots to the buyers just on the basis of mutual agreement, but then did not get the registry of the said plots done to the name of the purchasers.

The complaint moved by the complainant Surjeet Singh has also been signed by about 4 others.

Surjeet Singh alleged that his complaint is that the said two persons had allegedly forged documents of the land, sold it to us on the basis of mutual agreement and without further executing the registry of those plots on the fixed date. As the one of the accused Gaurav Kakkar belongs to the Bharatiya Janata Party, he threatens us with consequences if we put up a complaint against him in this regard. He also has some security personnels and allegedly has henchmen. He threatened to implicate us in a false case.

The complaint was then forwarded to the DSP sub division Kotkapura for the verification of the allegations.

The investigation officer,then DSP Kotkapura found that the allegations were true and the accused had neither got the registration of the disputed land in their name nor transferred it further as per law.

They had allegedly sold plots of land just on the basis of mutual agreement.

The investigation officer also noted that the complainants and respondents have also filed cases in civil courts.

But he said that after the perusal of record, it was found out that there were many illegalities in the execution of the sale purchase deeds and even respondents in the case did not appear to support their claims with proper documents.

Even the original owner who had allegedly sold the property worth over Rs 6.50 crore was yet to be given some more and the registry of the said land was not executed by the two in their names by paying the legal fees.

The colony in question, namely Radha Enclave showed 77 plots which were planned, but it was not allegedly approved.

The land in question is allegedly about 32 kanals.

The inquiry report was forwarded to SSP Faridkot on 4-4-23 after the legal opinion by the DA for the registration of the case against the two accused, Gaurav Kakkar andMukesh Kumar.

Then SSP Faridkot again sought the legal opinion of the DA and sought the comments of the DSP investigation Faridkot.

“After the perusal of the record and study of the case file submitted by the DSP sub division ,Kotkapura, I have found out that the respondents had purchased land from three persons, two of them are dead now and one stated that the buyers did not get the land registered in their name. The buyers had to get the registration of the land done in their name, but they further sold many plots only on the basis of the mutual agreement. Even after the 8 years of the initiation of the deal, all formalities have not been completed. Even the purchasers pocketed lakhs of money by selling plots and the responsibility of the development of the colony was with the purchasers but the colony was found unauthorised as it was not approved by them,” reads the note of DSP Investigation Faridkot.

He said that a case under section 406(breach of trust),420 (cheating) and 120 B(criminal conspiracy) was made out of the complaint and it be registered and FIR be submitted to the ilaqa magistrate.

Gaurav Kakkar allregs political vendetta

When contacted, Gaurav Kakkar,district president of the BJP, who is one of the accused in the case, said that the case was politically motivated.

“We are completing all the formalities and are ready to get the registries of the property in question done. They buyers already have the land in their possession and they have constructed their houses.The allegations are all false and political vendetta is there. They want to malign my image. I have also filed a case in civil court regarding this,” he said.

He further alleged that the police did not give them proper hearing.

SSP Faridkot,Harjeet Singh could not be contacted about his version in this regard
