The Punjab and Haryana High Court will hear on Monday an execution appeal filed by Gag Dhagara village seeking direction to the government to deposit the contract amount to the village.
It is listed before a bench of Justice Sureshwar Thakur and Justice Lalit Batra.
The Punjab and Haryana High Court has issued a notice of motion to the state of Punjab returnable by August 16, 2023.
A division bench comprising Justice Sureshwar Thakur and Justice Kuldeep Singh has passed this order on an Execution Appeal filed by Gag Dhagara village panchayat.
Village former sarpanch Banat Kaur has submitted in the court that the former sarpanches had filed a petition in the Punjab and Haryana High Court in 2015 seeking directions to a private contractor to deposit the balance amount of the contract money with the panchayat.
She said in her appeal that then Justice Surya Kant and Justice PB Bajanthri, disposing of the petition, had said in their judgment on February 2, 2016, that the needful, including the determination of the amount payable by the private contractor, should be done within three months. It had directed the Mining Department to deduct the amount from the security deposit and release the gram panchayat’s share within a month. The sarpanch submitted that an amount of Rs 1,48,15,757 was deducted by the Mining Department from the security deposit of the contractor, but the gram panchayat still didn’t get anything. She said the gram panchayat, in its meeting held on November 19, 2002, had passed a resolution for recovering the pending amount from the Mining Department and the Block Development and Panchayat Officer, Nurmahal. It sent the resolution to the Sub-Divisional Magistrate, Phillaur, but still, the panchayat was waiting to release the amount.
Meanwhile, executive engineer cum district mining officer Jalandhar in an official communication to the block development and penchant officer in March 2024 said that the chief engineer cum mining and Zoology and water resources department has sanctioned the release of Rs 1,48,15,757 to the panchayat of Gag Dhagara village and you are directed to send the bank account number and other details of panchayat. BDPO said that he has submitted all relevant details, but no money has been released yet.
