NAKODAR
The Punjab and Haryana High Court on Saturday disposed of the petition for registering a criminal case under section 302/307/34 IPC against the DM/SSP/SP (Operations)of Jalandhar in connection with the Nakodar police firing.
A bench of Justice Avneesh Jhingan said in his order that the present petition is filed for issuance of directions to respondents No.1 to 4 for registering FIR based on the inquiry report submitted by “Justice Gurnam Singh Commission of Inquiry, Punjab” and to constitute a High-level independent Special Investigation Team (SIT) for investigating the matter leading to the killing of four persons in an incident that occurred on 4th February 1986 at Nakodar.
Learned State counsel on instructions from Sukhpal Singh, DSP, Subdivision Nakodar, District Jalandhar (Rural), Inspector Satpal Singh Sidhu, SHO, Police Station City Nakodar submits that part of the inquiry report was misplaced. He further submits that acting upon the representation made by the petitioner, SIT has been constituted. He further submits that four FIRs relating to the incident were registered.
The court said that in view of the statement made by learned State counsel, the prayer for constituting SIT does not survive at this stage. The petition is disposed of.
It said that the petitioner shall be at liberty to avail remedies in accordance with the law for redressal of surviving grievances. Since the main case has been disposed of, pending application if any is rendered infructuous.
It is pertinent to mention here that a criminal petition was filed by Baldev Singh of village Littran, district Jalandhar, (presently with dual citizenship of India and Canada) in 2019 seeking the setting up of an SIT (Special Investigation Team), preferably of CBI, for an investigation into the killing of four young persons, including Ravinder Singh (son of the petitioner), after registering an FIR under Sections 302/307/34( IPC against the then Jalandhar district magistrate ( DM) (Darbara Singh Guru) the then Jalandhar Senior Superintendent of police (SSP) (Mohd Izhar Alam), and then Superintendent of police (SP) (Operations) (Ashwani Kumar Sharma,)
