Encroachments on public land by Dera: HC adjourns hearing to November 16

 

NAKODAR

 The Punjab and Haryana High Court on August 24 adjourned the hearing to November 16  on a civil writ petition challenging the concerned authorities’ failures to remove encroachments on public land by dera Lal Babshah.

Justice Rajesh Bharadwaj said in his order that the advocate Rahul Arora has appeared on behalf of respondent no 4 and filed a power of attorney which is taken on record and on his request adjourned to 16 -11-2023.

The court was hearing a petition filed by ex-councillor Hari Mittar Sondhi.

  Sondhi had submitted in the court that the dera’s managing committee had encroached on the local civic body’s land measuring 33 kanal 7 marla added that in July 2012, the Nakodar council had issued a notice to the dera to remove encroachment but of no avail.

Sondhi said that the then NC executive officer Varinder Jain had said that further action would be taken against the dera as per rules.

 Meanwhile, the Nakodar Nagar Council (NC) had accused its former member Hari Mittar Sondhi of misusing the process of law to advance his personal interest.

 The then executive officer R.S.Warraich  in his reply submitted in the Punjab and Haryana High Court had said that the present petition has been filed by Sondhi to settle the political score with  Pawan Gill who defeated Sondhi in civic body elections.

Sondhi had filed a civil writ petition in 2015 challenging the concerned authorities’ failure to remove encroachment by the managing committee of Dera Lal Badshah which had encroached 33 kanals 17 marls public land.

EO submitted in the court that the office of Trust Baba Lal Badshah is constructed on private land.

 

 He had said that NC in routine excise had issued notice to Chairman Baba Lal Badshah Trust to vacate the premises in the ownership of the municipal council in routine. No representation to remove encroachment was given to NC before filing the present petition.
