Supreme Court's big decision on Haryana Sikh Gurdwara Prabandhak Act 2014

CHANDIGARH: The Supreme Court in a judgment on Tuesday upheld the constitutional validity of the Haryana Sikh Gurdwara (Prabandhak) Act 2014.

 

A two-judge bench headed by Justice Hemant Gupta in the Supreme Court has rejected the Haryana government's plea to take over the Gurdwaras controlled by the Shiromani Gurdwara Prabandhak Committee (SGPC).

Justice Gupta, who read out the operative part, said that the petitions have been dismissed and the validity of the Act has been upheld. Full judgment

The Supreme Court in its decision has dismissed the petition filed against the law and the validity of the law has been upheld.

The petitioner Harbhajan Singh had challenged the Haryana law in the Supreme Court and said that the state legislature does not have the right to form any organization for the management of the Gurdwara. The petitioner said that only Parliament has this right.

Challenging the Haryana law, Harbhajan Singh told the Supreme Court that it is also a violation of the Sikh Gurdwara Act 1925, the States Reorganization Act 1956, the Punjab Reorganization Act 1966 and the Inter-State Corporations Act 1957.

 

Earlier, On March 29, the Court had overruled the preliminary objection raised by the State of Haryana regarding the maintainability of the petitions and decided to consider the matter on merits.
